The employer is no longer providing the Union with the useful and essential information
the members of the Transition Committee need to identify and represent route holders
and relief employees. The employer is violating the provisions of the collective
agreement, including, but not limited to Articles 11 and 34, and, consequently, is
causing harm to the affected employees and the Union and acting in bad faith.
Corrective Steps Requested
The Union requests a statement to the effect the employer is violating the provisions of
the collective agreement. The Union also requests an order requiring the Corporation to
provide the union members of the Transition Committee with all the information they
require. Furthermore, the Union requests an order requiring the Corporation to
compensate, with interest, the employees who are now or will be affected by the
Corporation's decision to no longer provide information to the union members of the
Transition Committee. Furthermore, the Union requests compensatory and punitive
damages for having acted in bad faith towards the Union and its members. Finally, the
Union reserves the right to request any other additional corrective action.
